App: AI Mirror – Phone Mirror app

1. Acknowledgement
This Agreement is concluded between you and [LEGAL ENTITY NAME] (“we”, “us”, “Licensor”) only, and not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for AI Mirror (the “Licensed Application”) and its content. This Agreement does not provide for usage rules for the Licensed Application that conflict with the Apple Media Services Terms and Conditions; in the event of a conflict, those terms prevail.
By downloading or using the Licensed Application, you agree to this Agreement. If you do not agree, do not use the Licensed Application. If you are below the age of majority in your jurisdiction, you must have the consent of a parent or guardian.
2. Scope of License
We grant you a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, including Family Sharing where applicable.
You may not distribute, sell, rent, lease, lend, or sublicense the Licensed Application, and you may not copy, modify, reverse engineer, decompile, disassemble, or create derivative works of it, except to the extent such restrictions are prohibited by applicable law.
3. Your Content
You retain all rights to the photos, images, documents, and text you provide to the Licensed Application (“Your Content”). We do not claim ownership of Your Content.
You grant us only a limited, non-exclusive licence to process Your Content for the sole purpose of providing the features you request — for example, transmitting a photo to our AI processing provider to generate your analysis result. This licence exists only for as long as necessary to deliver that result. We do not use Your Content to train AI models, to advertise, or for any other purpose, and we do not sell it.
You are responsible for ensuring you have the right to submit Your Content, and that doing so does not infringe anyone else’s rights. Do not submit images of other people without their permission.
4. Acceptable Use
You may not use the Licensed Application to break the law; to submit content that is unlawful, infringing, or that depicts another person without their consent; to attempt to identify or surveil any individual; to interfere with or disrupt the Licensed Application or its providers; or to submit false or misleading reviews.
5. AI Features and No Medical Advice
The Licensed Application uses artificial intelligence to produce cosmetic analyses, scores, simulations, and suggestions. These outputs are estimates generated by automated systems, are provided for general grooming and entertainment purposes only, and may be inaccurate or incomplete.
The Licensed Application is not a medical device. It does not provide medical advice, diagnosis, or treatment, and must not be relied upon for any health decision. If you have any concern about your skin, hair, or health, consult a qualified healthcare professional. Do not delay seeking professional advice because of anything the Licensed Application shows you.
6. Subscriptions and Payment
Core mirror features are free. AI Mirror Pro is an auto-renewing subscription offered in weekly, monthly and annual plans; the price applicable to your region is displayed in the App before you confirm.
Payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription in your Apple Account settings; cancellation takes effect at the end of the current paid period. If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
All purchases are processed by Apple and are subject to Apple’s terms. Refunds are handled by Apple in accordance with its policies; we cannot issue refunds directly.
7. Maintenance and Support
We are solely responsible for providing any maintenance and support services for the Licensed Application, as specified in this Agreement or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services for the Licensed Application. You can reach us at aimirror@puretools.app.
8. Warranty
We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. To the maximum extent permitted by applicable law, the Licensed Application is provided “as is” and “as available” without warranty of any kind.
In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
Nothing in this Agreement excludes or limits rights you have under mandatory consumer protection law.
9. Product Claims
We, and not Apple, are responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of it, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Licensed Application’s use of frameworks that process data.
10. Intellectual Property Rights
All rights in the Licensed Application itself — including its software, name, logo, interface, and included assets — belong to us or our licensors. In the event of a third-party claim that the Licensed Application or your possession and use of it infringes that third party’s intellectual property rights, we, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
11. Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
12. Third Party Terms of Agreement
You must comply with applicable third-party terms of agreement when using the Licensed Application.
13. Third Party Beneficiary
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement, and that upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary of this Agreement.
14. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Licensed Application. Our total aggregate liability will not exceed the greater of the amount you paid us for the Licensed Application in the twelve months preceding the claim, or USD 50. These limitations do not apply to liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or your mandatory consumer rights.
15. Termination
This Agreement is effective until terminated. Your rights end automatically if you fail to comply with any of its terms. You may terminate at any time by deleting the Licensed Application. We may suspend or discontinue the Licensed Application, in whole or in part, at any time.
16. Changes to These Terms
We may modify this Agreement. If changes are material, we will update the effective date and, where appropriate, notify you in the App. Your continued use after an update constitutes acceptance. If you do not agree, stop using the Licensed Application.
17. Governing Law and Disputes
This Agreement is governed by the laws of China, without regard to its conflict of law provisions. Disputes will be subject to the courts of GUANGZHOU.
Nothing in this section deprives you of the protection of mandatory consumer law in your country of residence. If you are a consumer in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protections, you retain the right to bring proceedings in the courts of your place of residence and to rely on the mandatory laws of that country.
18. Miscellaneous
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of it. This Agreement, together with our Privacy Policy, is the entire agreement between you and us regarding the Licensed Application.
